Profitap warrants to the original end user customer that its products are free from defects in material and workmanship. Subject to the conditions and limitations set forth below, Profitap will, at its option, either repair or replace any part of its products that prove defective by reason of improper workmanship or materials. All repaired parts or replacement products will be provided by Profitap on an exchange basis.

This limited warranty does not cover any damage to the product that results from improper installation, accident, abuse, misuse, natural disaster, insufficient or excessive electrical supply, abnormal mechanical or environmental conditions, or any unauthorized disassembly, repair or modification. This limited warranty shall not apply if:

  • The product was not used in accordance with any accompanying instructions
  • The product was not used for its intended function

This limited warranty also does not apply to any product on which the original identification information has been altered, obliterated or removed, that has not been handled or packaged correctly, that has been sold as second-hand or that has been resold contrary to international export regulation.

This limited warranty covers only repair and replacement for defective Profitap products, as provided above. Profitap is not liable for, and does not cover under warranty, any damages or losses of any kind whatsoever resulting from loss of, damage to, or corruption of, content or data or any costs associated with determining the source of system problems or removing, servicing or installing Profitap products. Profitap is not liable for any losses or damage attributable to third party software, hardware or connected equipment.

Replacement Before Repair Service

In order to provide the best service and security to our customers, we offer the “replacement before repair service” to furnish the best insurance for network security. Free of charge for the first 90 days from purchase, we keep a replacement product in stock in case of urgent demands the defective unit will have to be returned within 10 days after the receipt of the replacement unit. This service is applicable if the Profitap product(s) proves to be defective by reason of improper workmanship or materials. The response time shall not exceed 2 days at the receival of all identification information.

Duration of Warranty

One-Year Warranty

The following Profitap products are covered by this warranty for a period of one year from the date of purchase by the original end user customer:

  • All XX-Series, X2-Series and X3-Series Network Packet Brokers
  • All IOTA Probes
  • All Profitap Transceivers

Two-Year Warranty

The following Profitap products are covered by this warranty for a period of two years from the date of purchase by the original end user customer: all ProfiSharks and active (powered) Profitap TAPs.

Ten-Year Warranty

The following Profitap products are covered by this warranty for a period of ten years from the date of purchase by the original end user customer: all of our passive Fiber Optic TAPs.

This limited warranty applies only to the original end user customer for the term of the product warranty described herein. This limited warranty is non-transferable. Warranty extension packages can be added on request.

If you experience difficulty during the installation or subsequent use of a Profitap product, you may contact Profitap’s Technical Support department prior to servicing your system.

Warranty Claim Procedures and Requirements

To obtain warranty service, you may return a defective product to the Profitap production facilities, or the authorized Profitap dealer or distributor from whom you purchased the Profitap product.

Before returning the product please follow the following steps:

  • Be prepared to provide your company information, the model and serial number of the product(s) to be repaired, and the nature of the problem.
  • Along with the shipment, be sure to include documentation indicating the RMA that has been assigned to this return. Also, mark the RMA on the outside of the box. Failure to do this might delay repair and may even result in products being sent back.
  • The typical turnaround time for warranty repair is one week counted from date of arrival to date of shipment. Incoming shipping charges are the responsibility of the customer, the return by the same or similar service will be paid by Profitap.

The returned product will become the property of Profitap. Repaired or replacement product within the warranty period, will be shipped at Profitap’s expense.

THE WARRANTIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHERS WARRANTIES.

PROFITAP MAKES NO OTHER WARRANTIES, EXPRESSED OR IMPLIED, AND PROFITAP EXPRESSLY DISCLAIMS ALL OTHERS WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

MOREOVER, THE PROVISIONS SET FORTH ABOVE STATE PROFITAP’S ENTIRE RESPONSIBILITY AND YOUR SOLE AND EXCLUSIVE REMEDY WITH RESPECT TO ANY BREACH OF WARRANTY OR CONTRACT.

IN NO EVENT SHALL PROFITAP BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, WHETHER OR NOT FORESEEABLE OR FORESEEN, OR FOR THE COSTS OF PROCURING SUBSTITUTE GOODS, INCLUDING WITHOUT LIMITATION, COSTS OF REMOVAL AND REINSTALLATION OF GOODS, LOSS OF GOODWILL, LOSS OF PROFITS, LOSS OF SAVINGS, LOSS OF INFORMATION OR DATA, ARISING IN ANY WAY OUT OF THE SALE OF, USE OF, OR INABILITY TO USE, ANY PROFITAP PRODUCT OR SERVICE, EVEN IF PROFITAP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BUYER SHALL NOT EXPORT, RE-EXPORT, OR TRANSFER DIRECTLY OR INDIRECTLY, ANY PRODUCT, ITEM, OR TECHNICAL DATA RECEIVED FROM PROFITAP TO ANY COUNTRY OR USER TO WHICH SUCH EXPORT, RE-EXPORT, OR TRANSFER IS RESTRICTED BY THE LAWS OR REGULATIONS OF ANY COUNTRY WITHOUT FIRST OBTAINING ALL REQUIRED GOVERNMENTAL LICENCES, AUTHORIZATIONS, CERTIFICATIONS, AND APPROVALS AND, CONSULTING WITH PROFITAP TO DETERMINE IF EXPORT AUTHORIZATION IS REQUIRED FOR THAT END USER OR DESTINATION.

PROFITAP DOES NOT INCLUDE THE RIGHT TO COPY, MODIFY, REVERSE ENGINEER, DECOMPILE, OR DISASSEMBLE THE HARDWARE AND SOFTWARE.

LICENSES SHALL BE CONSTRUED, INTERPRETED AND GOVERNED BY THE LAWS OF THE NETHERLANDS, WITHOUT REGARD OR EFFECT GIVEN TO ITS OR ANY OTHER JURISDICTIONS CHOICE OF LAW JURISPRUDENCE.

AIRCRAFT

PROFITAP DOES NOT AUTHORIZE ANY OF PROFITAP’S GOODS FOR USE IN AIRCRAFT, AIRCRAFT DEVICES AND/OR SYSTEMS WITHOUT THE EXPRESS APPROVAL OF AN OFFICER OF PROFITAP.

AIRCRAFT DEVICES OR SYSTEM ARE INTENDED TO BE USED IN SUPPORT OF AIRCRAFT AND WHOSE FAILURE TO PERFORM CAN BE REASONABLY EXPECTED TO RESULT IN INTERFERENCE WITH AIRCRAFT COMMUNICATION SYSTEMS AND/OR SIGNIFICANT INJURY TO THE USER.

LIFE SUPPORT

PROFITAP DOES NOT AUTHORIZE ANY OF PROFITAP’S PRODUCTS FOR USE IN MEDICAL APPLICATIONS, INCLUDING, WITHOUT LIMITATION, LIFE SUPPORT DEVICES AND/OR SYSTEMS WITHOUT THE EXPRESS WRITTEN APPROVAL OF AN OFFICER OF PROFITAP.

LIFE SUPPORT DEVICES OR SYSTEMS ARE INTENDED FOR SURGICAL IMPLANT INTO THE BODY OR SUPPORT OR SUSTAIN LIFE AND WHOSE FAILURE TO PERFORM, WHEN PROPERLY USED IN ACCORDANCE WITH INSTRUCTIONS FOR USE PROVIDED IN THE LABELLING, CAN BE REASONABLY EXPECTED TO RESULT IN SIGNIFICANT INJURY TO THE USER.
